1. Service Provider (Legal Notice)

In compliance with Article 10 of Spain's Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), we provide the following identification:

2. Acceptance of Terms

By accessing or using Close Enough (“the Service”), you agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy. If you do not agree, please do not use the Service.

3. Description of the Service

Close Enough is an AI-powered service that generates professional portrait photographs from selfies you upload. The service uses AI to create portrait images based on your preferences and style settings.

4. Eligibility

You must be at least 18 years old to use the Service. By using Close Enough, you confirm that you are 18 or older and have the legal capacity to enter into these Terms.

5. How the Service Works

1. Upload selfies — You upload selfie photographs of yourself following our photo guidelines.
2. Configure your looks — You customize the style and settings for your portrait photos.
3. AI generation — Our AI creates professional portrait photographs based on your selfies and settings.
4. Download results — Your generated portraits are available for download for 30 days after generation completes, after which they are permanently deleted.

6. Your Photos & Content

6.1 Your Uploaded Photos

You retain all ownership rights to the selfie photographs you upload. By uploading them, you grant us a limited, temporary license to process them solely for the purpose of generating your portrait photos. This license ends when your photos are deleted (automatically after 30 days, or earlier upon your request).

6.2 AI-Generated Portraits

You own the AI-generated portrait photos. Once generated, the portraits are yours to use for any purpose, such as personal use, social media, professional profiles, resumes, and commercial use. We do not claim any ownership or license over your generated portraits.

6.3 Photo Guidelines

You must only upload photos of yourself (or photos for which you have explicit permission from the person depicted). You must not upload:

• Photos of other people without their consent
• Photos of minors (anyone under 18)
• Illegal, obscene, or offensive content
• Content that infringes on any third party's rights

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload photos of people without their consent
• Attempt to circumvent upload limits or abuse the Service
• Use the generated images to impersonate, deceive, or defraud others
• Use automated systems (bots, scrapers) to access the Service
• Reverse-engineer or attempt to extract our AI prompts or system design

We reserve the right to terminate access to the Service if you violate these terms.

8. AI-Generated Content Disclaimer

The portrait photographs are generated by artificial intelligence. While we strive for high quality, please be aware that:

• AI results may vary in quality and likeness
• Generated portraits may not perfectly resemble you
• Small artifacts or imperfections may occur
• Results depend significantly on the quality of your uploaded selfies

We guarantee that at least one of your generated photos will be usable. If none are usable and you followed our selfie guidelines, you are covered by our refund policy (see Section 10).

9. Intellectual Property

The Close Enough platform — including its design, code, branding, logos, UI, AI prompts, and all associated materials — is owned by us and protected by applicable intellectual property laws. These Terms do not grant you any rights to our platform, brand, or technology beyond the right to use the Service as intended.

10. Payment & Refunds

10.1 Payment

Payments are processed by LemonSqueezy, which acts as the Merchant of Record. Prices are displayed on our website and may be subject to applicable taxes. By purchasing, you agree to LemonSqueezy's Terms of Service.

10.2 Refund Policy

We offer refunds under the following conditions:

• Before generation starts — If AI generation has not yet begun, you may request a full refund within 14 days of purchase, no questions asked. This is your right of withdrawal under the EU Consumer Rights Directive.
• After generation completes — If none of your generated photos are usable, you followed our selfie guidelines, and you contact us within 14 days of purchase with your results, we will issue a full refund. Unlike many competitors, downloading your photos to check them does not void your refund rights.

10.3 Right of Withdrawal

Under the EU Consumer Rights Directive (2011/83/EU), you have a 14-day right of withdrawal for purchases made online. By initiating AI generation, you consent to the immediate performance of the service and acknowledge that the standard right of withdrawal is replaced by our quality-based refund policy described above.

11. Data Retention & Privacy

Your uploaded selfies and generated portraits are automatically and permanently deleted 30 days after your most recent session activity. You may request earlier deletion at any time by emailing us. For full details on how we handle your data, please refer to our Privacy Policy.

12. Service Availability

The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time without prior notice. We will make reasonable efforts to complete any ongoing generation sessions before any planned interruption.

13. Limitation of Liability

To the maximum extent permitted by applicable law (including Spanish and EU consumer protection law):

• Our total liability for any claim arising from or related to the Service is limited to the amount you paid for the specific session giving rise to the claim.
• We are not liable for any indirect, incidental, special, or consequential damages, such as loss of profits, data, or business opportunities.
• We are not liable for the quality, accuracy, or likeness of AI-generated portraits beyond our refund policy.

Nothing in these Terms limits or excludes liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded under applicable law.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Tarragona, Spain.

If you are a consumer resident in the European Union, you also enjoy the protection of mandatory consumer protection provisions of the law of your country of residence. Additionally, you may use the EU Online Dispute Resolution platform to seek resolution of disputes.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify you via a notice on our website.
